Website Terms of Use
Effective date: 6 November 2026
These Website Terms of Use ("Terms") govern your use of newcura.com and any pages that link to these Terms (the "Site"), operated by Summit Imaging, Inc., a Missouri corporation doing business as NewCura ("NewCura," "we," "us"), 200 Unity Cir, Suite A, Lee's Summit, MO 64086. By using the Site, you agree to these Terms. If you are using the Site on behalf of an organization, you agree on its behalf and confirm you have authority to do so. If you don't agree, please don't use the Site.
1. These Terms cover the website, not our software
The Site gives information about NewCura, our products (including EndoManager® EMS, EndoManager Reporting and ScopeCycle®) and our services. Use of NewCura software, support and professional services is governed only by the separate written agreement between NewCura and the customer (for example, a license, subscription, services or business associate agreement). If those agreements conflict with these Terms, those agreements control for their subject matter.
2. Who the Site is for
The Site is intended for healthcare organizations, their staff and other business users located in the United States, Canada, Australia and the Middle East. It is not directed to consumers or patients and not directed to children.
3. Not medical advice; no patient information
Content on the Site is general product and company information. It is not medical, clinical, legal, regulatory or reimbursement advice, and it does not replace the professional judgment of clinicians or your own advisers. Product capabilities, compatibility and integrations depend on your environment and configuration and are confirmed only in writing for your project.
Do not submit patient information (protected health information) through the Site, its forms or by email. The Site is not designed to receive it. If we need to see patient-specific data to support you, we will arrange a secure method under your agreement with us.
4. Information on the Site
We work to keep the Site accurate and current, but content may contain errors or become out of date, and we may change it at any time without notice. Product descriptions, specifications, screenshots, timelines and pricing information are provided for general information. Nothing on the Site is an offer, a warranty or a binding commitment; only a signed agreement or quote from NewCura is. Any statements about future features are not a promise to deliver them.
5. Acceptable use
You agree not to:
- use the Site in violation of any law, or to infringe anyone's rights;
- attempt to gain unauthorized access to the Site, our systems, or any account, or probe, scan or test their vulnerability except under a written arrangement with us;
- interfere with or disrupt the Site, including by introducing malware or sending excessive automated requests;
- scrape, harvest or bulk-download Site content or contact information by automated means, except as allowed by our robots.txt;
- submit false, misleading or unlawful information through our forms, or impersonate any person or organization; or
- use the Site to send unsolicited commercial messages.
6. Intellectual property
The Site and its content, including text, graphics, logos, images, videos, software and the selection and arrangement of content, are owned by NewCura or its licensors and are protected by copyright, trademark and other laws.
You may view and print pages for your own internal business purposes, such as evaluating NewCura products, provided you keep all copyright and other notices. Any other use, including reproducing, modifying, distributing or creating derivative works, requires our prior written permission.
Trademarks. EndoManager® and ScopeCycle® are registered trademarks of Summit Imaging, Inc. d/b/a NewCura. Other NewCura names and logos are trademarks of NewCura. Third-party names and marks shown on the Site, including Epic, Lumens, OpTime®, Epic Showroom™, Olympus, FUJIFILM and PENTAX, belong to their respective owners. Their use does not imply endorsement by, sponsorship by or affiliation with those owners, except as expressly stated.
7. Your submissions and feedback
When you submit information through the Site, you confirm that it is accurate, that you have the right to provide it, and that it contains no patient information. We handle personal information as described in our Privacy Policy.
If you send us ideas, suggestions or feedback about our products or Site, we may use them without obligation to you.
8. Third-party sites and services
The Site links to or uses third-party sites and services, such as Microsoft Bookings for demo scheduling, Epic Showroom listings and LinkedIn. We don't control them and aren't responsible for their content, availability or practices. Your use of them is governed by their own terms and privacy policies.
9. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. THIS SECTION DOES NOT AFFECT ANY WARRANTY IN A SEPARATE WRITTEN AGREEMENT WITH NEWCURA.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEWCURA AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED US $100. THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW AND DOES NOT APPLY TO SEPARATE WRITTEN AGREEMENTS WITH NEWCURA.
11. Indemnity
To the extent permitted by law, you will indemnify and hold harmless NewCura and its affiliates, officers and employees from any claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the Site.
12. Governing law and disputes
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Jackson County, Missouri, and you consent to their jurisdiction.
13. Export and sanctions
You may not use or access the Site in violation of US export control or sanctions laws.
14. Changes and termination
We may change these Terms by posting an updated version on this page with a new "last updated" date. Changes apply from that date; continuing to use the Site means you accept them. We may suspend or restrict access to the Site at any time.
15. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and NewCura about the Site (separate written agreements with NewCura govern our products and services). You may not assign these Terms; we may assign them in connection with a reorganization or transfer of our business.
